However, reports from several reliable sources claim that AT&amp;T<sup>\u00ae<\/sup> has just lost the case, as the US District Court Judge David Hale dismissed the lawsuit by stating that the claims made by the telecom company are false.<\/p>\n<p style=\"text-align: justify;\">The officials from <span style=\"color: #333399;\"><strong><a href=\"https:\/\/www.thetripleplay.net\/att-internet\/\">AT&amp;T<\/a><\/strong><\/span><sup>\u00ae<\/sup> responded to the issue by stating that, \u201cWe are currently reviewing the decision and our next steps.\u201d The telecom giant also claimed that Louisville does not have any jurisdiction under state or federal law for regulating the pole attachment.<\/p>\n<p style=\"text-align: justify;\">One Touch Make Ready laws allow ISPs to make all the necessary wide adjustments on their own. This means that these ISPs will not have to wait for other internet providers such as AT&amp;T<sup>\u00ae<\/sup> to send their work crews for moving the wires. If there were no One Touch Make Ready rules, then the pole attachment process could be delayed for months.<\/p>\n<p style=\"text-align: justify;\">Hale wrote that AT&amp;T<sup>\u00ae<\/sup> had argued that the referred to in-court documents since Ordinance No. 21 \u201cimpermissibly regulates the terms and conditions of pole attachments,\u201d but in doing so, the telecom company referred to in-court documents as Ordinance No. 21 \u201cimpermissibly regulates the terms and conditions of pole attachments.\u201d<\/p>\n<div id=\"attachment_2263\" style=\"width: 310px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.thetripleplay.net\/\" rel=\"attachment wp-att-2212\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-2263\" class=\"wp-image-2263 size-medium\" title=\"Necessary Wide Adjustments\" src=\"https:\/\/www.thetripleplay.net\/blog\/wp-content\/uploads\/2017\/02\/Internet-Providers-2-300x210.jpg\" alt=\"Internet Providers\" width=\"300\" height=\"210\" srcset=\"https:\/\/www.thetripleplay.net\/blog\/wp-content\/uploads\/2017\/02\/Internet-Providers-2-300x210.jpg 300w, https:\/\/www.thetripleplay.net\/blog\/wp-content\/uploads\/2017\/02\/Internet-Providers-2.jpg 640w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-2263\" class=\"wp-caption-text\"><em><strong>One Touch Make Ready Ordinance<\/strong><\/em><\/p><\/div>\n<p style=\"text-align: justify;\">The reality is that \u201cthe ordinance actually prescribes the &#8216;method or manner of encumbering or placing burdens on&#8217; public rights-of-way,\u201d Hale wrote. He further said that the Public Service Commission of Kentucky has exclusive jurisdiction over services of utilities and regulation of rates, and added that cities are allowed to \u201cregulate local utilities in every area except as to rates and service.\u201d<\/p>\n<p style=\"text-align: justify;\">\u201cLouisville Metro has an important interest in managing its public rights-of-way to maximize efficiency and enhance public safety,\u201d Hale wrote. \u201cAnd Kentucky law preserves the right of cities to regulate public rights-of-way. Because Ordinance No. 21 regulates public rights-of-way, it is within Louisville Metro\u2019s constitutional authority to enact the ordinance, and [Kentucky law] cannot limit that authority.\u201d<\/p>\n<p style=\"text-align: justify;\">\u201cThe Metro Council uses the &#8216;strike-through and underscoring method&#8217; of amending the municipal Code, which identifies both the language to be repealed and the new language to be added. This is the longstanding practice of the Metro Council when enacting ordinances that amend the Code.
