The Media Bureau of FCC termed the petition as a \u2018program access complaint\u2019, and stated that there are deadlines to file complaints of such nature.<\/p>\n<p style=\"text-align: justify;\">\u201c[W]e dismiss the Petition because Wave<sup>\u00ae<\/sup> did not file within the time limit that our program access rule requires,\u201d said the Commission in a ruling favorable to Comcast<sup>\u00ae<\/sup>. FCC accepted the argument of the Telco giant that the petition against them from their rival was filed \u201cin the final month of the contract terms, long after the [FCC&#8217;s one-year statute of] limitations periods expired.\u201d<\/p>\n<p style=\"text-align: justify;\">Wave Broadband<sup>\u00ae<\/sup> has over 400,000 subscribers in California, Oregon, Washington, whereas Comcast<sup>\u00ae<\/sup> has over 22 million TV subscribers nationwide and owns several TV networks. Cable providers pay Comcast<sup>\u00ae<\/sup> for accesses to TV programming channels. The petition from Wave Broadband<sup>\u00ae<\/sup> against regional sports networks owned by Comcast<sup>\u00ae<\/sup> stated that the company\u2019s practices \u201chad the effect of withholding must-have regional sports programming from the largest cable competitor to Comcast Cable<sup>\u00ae<\/sup> on the West Coast unless Wave<sup>\u00ae<\/sup> agreed to pay a punitive ransom totaling nearly $3.5 million.\u201d<\/p>\n<p style=\"text-align: justify;\">Both Wave Broadband<sup>\u00ae<\/sup> and Comcast<sup>\u00ae<\/sup> signed a contract back in October 2014, that required Wave<sup>\u00ae<\/sup> to deliver the Comcast-owned sports networks to a particular portion of the overall customers. \u201cUltimately, Wave<sup>\u00ae<\/sup> was not able to maintain the contracts\u2019 agreed-upon subscriber penetration percentage terms\u2014a result that Wave<sup>\u00ae<\/sup> attributes to Comcast\u2019s decision to offer its regional sports networks through different distribution methods\u2014and Wave<sup>\u00ae<\/sup> agreed in July 2017 to cure the breach of contract with a payment of damages to Comcast<sup>\u00ae<\/sup>,\u201d noted Federal Communications Commission on the dispute.<\/p>\n<div id=\"attachment_1600\" style=\"width: 310px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.thetripleplay.net\/\" rel=\"attachment wp-att-1600\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-1600\" class=\"wp-image-1600 size-medium\" title=\"Comcast Corporation\u00ae\" src=\"https:\/\/www.thetripleplay.net\/blog\/wp-content\/uploads\/2016\/10\/televizija-66443384-e1477023126423-300x201.jpg\" alt=\"Cable Providers\" width=\"300\" height=\"201\" srcset=\"https:\/\/www.thetripleplay.net\/blog\/wp-content\/uploads\/2016\/10\/televizija-66443384-e1477023126423-300x201.jpg 300w, https:\/\/www.thetripleplay.net\/blog\/wp-content\/uploads\/2016\/10\/televizija-66443384-e1477023126423.jpg 600w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-1600\" class=\"wp-caption-text\"><em><strong>Leading Cable Provider <\/strong><\/em><\/p><\/div>\n<p style=\"text-align: justify;\">The \u2018different distribution methods\u2019, refers to the video services that carry online content from Comcast\u2019s sports networks. Many of the customers, who subscribe to TV service, said that Wave<sup>\u00ae <\/sup>adds an online video service. That is what contributed to Wave\u2019s failure to keep deliver Comcast-owned content to the subscriber percentage as mentioned in the contract.<\/p>\n<p style=\"text-align: justify;\">Wave Broadband<sup>\u00ae<\/sup> argued that Comcast<sup>\u00ae<\/sup> made a threat to drop sports networks from the TV service if Wave<sup>\u00ae<\/sup> did not pay more, which they agreed to in turn seeking refunds.
